Nairobi — A group of squatters has cited the Lands Commissioner for contempt after he allegedly issued a cancelled title to a public institution.
The registrar of titles was also cited for registering a title, which was allegedly backdated to January 2010, in favour of Mombasa Technical Training Institute (MTTI).
In March this year, Mombasa High Court judge Jackton Ojwang' allowed the 117 squatters to resettle on the piece of land in Shanzu from where they had been evicted by the MTTI.
The judge also quashed a decision by the Lands Commissioner granting MTTI ownership of the 27-acre property and cancelled the title.
However, the squatters claim, after receiving the court order on April 6, 2010, the Lands Commissioner instructed the registrar to backdate the registration date to January and issue the title afresh.
The squatters were evicted last year when the MTTI hired a bulldozer and flattened 50 houses.
The squatters, who say they settled on the land in 1942, applied for allocation in 1971, 1990 and in 2009 but the lands office had persistently refused to issue the relevant documents.
