Nairobi — An abuse of office case against two former permanent secretaries has been temporarily stopped by the High Court.
This follows successful applications by Mr Samson Teela Akute and Mr Peter Maina Wakori, both former accounting officers in the ministry of Public Works.
The order by Lady Justice Kalpana Rawal will stay in force until September 27. The case had been scheduled for hearing on September 21.
Abuse of law
Mr Akute said he was being tried for an offence he was cleared of 12 years ago. He claimed the charge was against the due process of the law because he was being charged twice for the same offence.
The former PS says the charge he is facing relates to a contract he did not sign. Mr Wakori says he was a PS in the Ministry of Public Works and Housing in 2002.
According to him, the charges have been pressed against him eight years after the said contracts were awarded and construction of the said roads completed.
The two have been charged alongside former Nairobi Town Clerk Godfrey Mate.
