Nairobi — A man who bought sodas and cakes for a group of young children before defiling a five-year-old girl has been sentenced to life imprisonment.

Wesley Kiprono Mutai, 42, was described by Makadara resident magistrate Abdulqadir Lorot "as a sex-pest who did not deserve any leniency and therefore unfit to live in civilised society."

In his mitigation, Mutai said he was married with five children who depended on him. "The accused has not shown any remorse at all. He has no value for life of children although he says he is a father of five. There is only one sentence provided under the law for this offence. Life imprisonment," Mr Lorot said while handing out the sentence.

Mr Lorot said the prosecution led by senior State counsel Agnes Tuta proved the case "beyond reasonable doubt." "This is a straightforward case. Ms Tuta produced before me witnesses who positively identified the accused as the man who was caught red-handed by the mother of the complainant defiling her inside his house."

The court said the accused found the girl playing with other children outside their house in Mathare North Area 4, Nairobi County, on April 14, 2008. He invited them to his house where he served them with soda and cakes.

The former waiter entertained them then chased all the other children and remained behind with the complainant. By 6.30pm the girl had not returned to their house and her mother became concerned. She asked her playmates about her whereabouts and they directed her to the accused's house which he had locked from inside.

She forced the door to open and found the accused in the act. Neighbours helped arrest Mutai whom they frogmatched to Muthaiga Police Station where he was locked up and later charged.

They took the girl to Nairobi Women's Hospital where she was treated and attended counselling sessions. "I commend Chief Inspector Catherine Ringera for conducting proper and sound investigations in this case," Mr Lorot observed. The officer, he said, moved with speed and pieced together all the testimony which led to the conviction.
